iiNet wins piracy court case

In a case that may have impacted Aussies internet users and companies like the immediate threat of the great URL filter, the case was contested in court with ISP iiNet taking on Australian Federation Against Copyright Theft (AFACT), who represented most of the heavyweights in the music and move industries over copyrighted material. The premise of the case was simple; they attempted to persuade the court that iiNet was legally liable for alleged copyright infringement activity by its customers. In a far fetched attempt, they tried to blame the service provider for allowing piracy to occur, just by providing the internet connection service. iiNet has won the court case, but if AFACT won, the laws could have changed with active filtering for copyrighted work being used and forced disconnections for end users. AFACT have to pay costs and it is good to see that providing a product or service does not legally hold you responsible for end users activities.

AFACT are retarded/

why iiNet specifically? There case seems to be valid for EVERY isp in the world....

why not just turn off the internet while your at it

Am sure it was coated in more fancy legal language, but basically iiNet would have been a big enough target to be worth the while of the movie publishers (ie, have enough to be fined multi-millions if they'd won), but small enough to be attacked (ie, if had gone after a Telstra, Optus etc, they'd have deep enough pockets to afford to tangle the process up in legal arguements for years and years).

Oh, and you can be sure every other ISP *was* watching with keen interest!

Thankfully, commonsense has prevailed! Sueing an ISP for their user's illegal downloads would be like charging a hammer maker with murder because one of their hammers was used to bludeon someone to death.

Every Internet user needs to take responsibility for their own actions on the Internet. So it is important to remember, this ruling does not condone illegally downloading movies etc, only that an ISP cannot be held responsible for their user's actions.
